These Terms and Conditions ("Terms") apply when you use the Swoper mobile app and the website swoper.co.za (together, "Swoper"). Swoper is operated by Swoper ("we", "us" or "our"). By creating an account or using Swoper you agree to these Terms. If you do not agree, please do not use Swoper.
1What Swoper is
Swoper is a platform that helps people in South Africa swop (exchange) items with each other. We provide the tools to list items, make and respond to offers, chat and leave reviews. We are not a party to any swop. Each swop is an agreement between the members involved, and we do not own, inspect, store, deliver or guarantee any item.
2Who can use Swoper
You must be at least 18 years old and able to enter into a binding agreement under South African law. You must give accurate information when you register and keep it up to date. You are responsible for everything that happens on your account, so keep your password private. One person may hold only one account unless we agree otherwise.
3Listings
You may only list items that you own and are legally allowed to swop. Your listing, photos and description must be honest and accurate, including the item's condition. You may not list stolen, counterfeit, illegal, dangerous or recalled items, weapons or ammunition, drugs or medicines, alcohol or tobacco, live animals, adult content, personal or financial information, or anything that infringes someone else's rights. We may remove any listing, without notice, that breaks these Terms or that we reasonably believe puts people at risk.
4Offers, swops and meeting up
An offer is a proposal to swop one of your items for another member's item. When an offer is accepted, the members agree the details of the swop between themselves in the chat. You are responsible for checking an item before you swop, for your own safety and for any costs you choose to incur. We recommend meeting in a busy, public place during the day, telling someone where you are going and never sharing banking or card details. Swoper does not handle payments between members.
5Free accounts and limits
Free accounts can make 20 offers in a 6-hour period. The period starts when you send your first offer and your allowance renews when the 6 hours end. Free accounts can have up to 5 active listings at a time; closed, swopped and removed listings do not count towards this limit. We may change these limits from time to time and will show the current limits in the app.
6Verified membership
Verified membership costs R29.99 per month and gives you unlimited offers, unlimited listings, a boost in the home feed and search results and a verified badge. You need both an approved identity review and an active subscription for the membership and badge to apply. Paying does not guarantee approval. To verify, you upload an identity document and a selfie, which we review privately. A verified badge confirms that we reviewed a person's identity document. It is not a guarantee of that person's behaviour or of any item or swop. We may refuse or revoke verification for fraud, misuse or a breach of these Terms, and renewing a subscription does not restore revoked verification.
7Subscriptions, boosts and refunds
Subscriptions and listing boosts are bought and billed through the Apple App Store or Google Play and are subject to their terms. Subscriptions renew automatically each month until you cancel them in your App Store or Google Play subscription settings; you keep your benefits until the end of the paid period. Deleting your Swoper account does not cancel a store subscription. A listing boost is a once-off purchase for 1, 7 or 30 days, starts when it is activated and does not renew. A boost increases visibility but does not guarantee views, offers or a swop. Refunds are handled by Apple or Google under their refund policies. Nothing in these Terms limits any rights you have under the Consumer Protection Act, 2008 or the Electronic Communications and Transactions Act, 2002.
8Acceptable behaviour
You agree not to: harass, threaten or discriminate against anyone; post false, misleading or offensive content; scam or attempt to defraud members; ask for or send money, deposits or banking details through Swoper; impersonate any person; create fake accounts or reviews; collect other members' information; send spam; interfere with or try to gain unauthorised access to Swoper; or use Swoper for any unlawful purpose.
9Reviews, reports and blocking
Reviews must be honest and based on a real swop. You can report a listing or a member and you can block anyone at any time. Reports are reviewed privately by our team and we may take any action we consider appropriate, including warning, suspending or removing an account.
10Your content
You keep ownership of the photos and text you post. You give us a non-exclusive, royalty-free licence to host, display, resize and share your content within Swoper and in links you or others share, for as long as it is on Swoper. You confirm that you have the right to post it.
11Suspension and closing your account
You can delete your account at any time in the app under My Profile, Account settings, Delete account, or by emailing [email protected]. We may suspend or close an account that breaks these Terms, puts other people at risk or is required to be closed by law.
12Availability and changes
We work to keep Swoper available but cannot promise that it will always be uninterrupted or error-free. We may change or discontinue features. We may update these Terms and will tell you about important changes in the app or on swoper.co.za. If you continue to use Swoper after a change takes effect, the updated Terms apply.
13Liability
Swoper is provided "as is". To the extent permitted by law, we are not liable for the items, conduct or statements of members, for any swop between members, or for any indirect or consequential loss. Where we are found liable, our total liability is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded under South African law, including liability for gross negligence or fraud.
14Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. If you have a complaint, please contact us first at [email protected] so that we can try to resolve it. Any dispute that cannot be resolved between us will be decided by the courts of the Republic of South Africa, and you and we submit to their jurisdiction.
